1. Who we are

Silky is operated by Magic Hire Solutions Limited ("we", "us", "our"). We provide an AI-powered recruitment platform that enables businesses to manage job postings, candidate pipelines, careers pages, and hiring analytics.

2. Your account

To access Silky, you are required to create an account. In doing so, you agree that:

• You will provide accurate, current, and complete information and keep it up to date.
• You are responsible for all activity occurring under your account and for maintaining the confidentiality of your access credentials.
• Silky uses passwordless Magic Link authentication. Access to the platform is tied to your registered email address.
• You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use Silky.

3. Permitted and prohibited use

Silky is a business tool designed for legitimate recruitment purposes. You may use the platform to:

• Generate and publish job advertisements.
• Manage candidates through your hiring pipeline.
• Build and publish a careers page for your organisation.
• Track interviews and analyse hiring performance.

You agree not to use Silky to:

• Post discriminatory, misleading, or fraudulent job advertisements.
• Collect or process candidate data for any purpose other than legitimate recruitment.
• Scrape, reverse-engineer, or extract data from the platform.
• Deploy automated tools to access the platform in a manner that damages or overloads its infrastructure.
• Violate any applicable employment, privacy, or anti-discrimination laws.

4. Candidate data and your responsibilities

In using Silky, you may store personal data relating to job applicants, including names, email addresses, CVs, and recruitment notes. In this context, you are the data controller and Magic Hire Solutions Limited acts as your data processor.

As data controller, you are responsible for ensuring that:

• You have a lawful basis for collecting and processing candidate personal data.
• Such data is handled in accordance with all applicable privacy and data protection laws in your jurisdiction.
• Candidate data is not retained beyond what is necessary for your recruitment process.
• Any candidate request for erasure of their personal data is actioned promptly through the platform.

5. AI-generated content

Silky utilises proprietary AI technology to assist in the generation of job advertisements. Please note the following:

• AI-generated content is provided as a draft for your review and should not be published without appropriate human oversight and editing.
• We do not warrant that AI-generated output will be accurate, complete, or suitable for any particular role or jurisdiction.
• You remain solely responsible for the content you publish, including compliance with applicable employment and advertising laws.

6. Subscription and payments

Silky offers both a free tier and paid subscription plans. The following terms apply to paid plans:

• Payments are processed securely by our third-party payment provider. We do not store payment card details.
• Subscriptions renew automatically on a recurring basis unless cancelled prior to the renewal date.
• We reserve the right to revise pricing, subject to providing reasonable prior notice before any increase takes effect.

Refund requests are considered on a case-by-case basis. Please direct billing queries to hello@silky.so.

7. Intellectual property

All elements of the Silky platform, including its design, code, templates, and features, are the intellectual property of Magic Hire Solutions Limited. Subject to these terms, we grant you a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose during the period of your subscription or free access.

Content created by you using Silky, including job advertisements and careers page content, remains your property. By using the platform, you grant us a limited licence to process and display such content solely for the purpose of delivering the service.

8. Availability and modifications

We endeavour to maintain the availability and reliability of Silky at all times; however, we cannot guarantee uninterrupted access. Scheduled or emergency maintenance may require temporary downtime, and we will provide advance notice where reasonably practicable.

We reserve the right to modify, update, or discontinue features of the platform. We will notify users of any material changes that affect the core functionality of the service.

9. Termination

You may close your account at any time via your account settings. We reserve the right to suspend or terminate accounts found to be in breach of these terms, with notice provided where it is reasonable to do so.

Upon termination, your personal data will be handled in accordance with our Privacy Statement.

10. Limitation of liability

To the fullest extent permitted by applicable law, Magic Hire Solutions Limited shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of or inability to use the platform. Our aggregate liability to you shall not exceed the total amount paid by you to us in the twelve months preceding the relevant claim.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or rights conferred by applicable consumer protection legislation.

11. Governing law

These terms are governed by applicable law. Any disputes arising from or in connection with these terms or your use of Silky shall be resolved through the appropriate legal channels in your jurisdiction.

12. Amendments

We may update these Terms of Use from time to time. Where changes are material, we will notify you by email or via an in-platform notice prior to the changes taking effect. Your continued use of Silky following such notification constitutes acceptance of the revised terms.
